Challenges and Development Direction of the Reform of Relatively Concentrated Power of Administrative License

摘要相对集中行政许可权改革的目的是加速许可速度,方式是主体集中,行政审批局是典型模式。行政审批局模式面临集中范围、专业能力、条块衔接、许可行为整合、信息系统、社会认知方面的问题,原因是条块结合体制的体系强制、行政许可与其他监管行为的一体性、中央为主制度供给体制对地方的制约性等。该项改革要坚持相对集中,避免绝对集中,发挥条与块、综合监管与专业行政、线上与线下许可的各自比较优势;修改《行政许可法》,规定省、自治区、直辖市可以将复数许可行为整合设置为综合许可,明确原行政机关在实质审查许可中的现场核查和事后监督检查职责。 The reform of relatively concentrated power of administrative licensing is to speed up administrative licensing by the way of concentrating almost all the licensing powers to the administrative licensing bureau.But the model of administrative licensing bureau is facing the problems of the licensing scope,professional ability,cooperation of departments and regions,integration of different licenses,information technology system,and social cognition,owing to some reasons such as the system force of the integration of departments and regions,the unity of the administrative license and other administrative powers,and the restriction on local legislation from the legal structure of central authorities.The reform should insist on relatively instead of absolutely concentrated power of administrative license,play the comparative advantages of departments and regions,comprehensive regulations and professional regulations,and online administrative licenses and offline administrative licenses,revise the Administrative Licensing Law to integrate different administrative licenses in the same field into a comprehensive license in provinces,autonomous regions and municipalities directly under the central government,assign the obligations of substantive examination before licensing,and check and supervise after licensing to the original administrative agency instead of the administrative licensing bureau.
