非常规重大突发事件“紧急行政”模式的法治优化被引量：21

The Optimization of Rule of Law of “Emergency Administration” Mode for Unconventional Major Emergencies

摘要突发新型传染病疫情等非常规重大突发事件已构成国家治理的重大现实挑战。基于防范系统性公共危机而启动以"紧急行政"为主导的国家紧急权力,将可能成为应对非常规重大突发事件不得不作出的治理模式选择。检视非常态、极限化风险治理情境下行政主导危机应对全过程的"紧急行政"模式,目前面临法律条件不足、行政权力越位、司法角色偏移、守法合作困难和法治监督悖论等现实问题。非常规重大突发事件"紧急行政"模式需依循应急管理的法治原则进行系统优化,从推进应急法制体系革新,加强"紧急行政"的自我规范、司法保障、守法激励以及法治监督等方面,构建非常规重大突发事件"紧急行政"应对模式下的良法善治。 Unconventional major emergencies such as the sudden outbreak of new infectious diseases have constituted a major realistic challenge to national governance.The activation of national emergency power led by"emergency administration"based on preventing systemic public crises may become the choice of governance model that must be made in response to unconventional major emergencies.Examining the"emergency administration"model of the whole process of administrative-led crisis response in the context of abnormal and extreme risk governance,it is currently facing real problems such as insufficient legal conditions,offside administrative power,deviation of judicial roles,difficulties in law-abiding cooperation,and the paradox of rule of law supervision.The"emergency administration"mode of unconventional major emergencies needs to be systematically optimized in accordance with the rule of law principles of emergency management.It is constructed in terms of advancing the innovation of the emergency legal system and strengthening the self-regulation of"emergency administration",judicial guarantees,law-abiding incentives and supervision good law and good governance under the"emergency administrative"response mode of unconventional major emergencies.
