摘要
根据《刑诉法》规定,对于强制医疗案件人民法院应当组成合议庭进行审理,但对合议庭组成模式却未明确规定。基于实践中基层人民法院对审理强制医疗案件合议庭组成方式的实证研究发现,审理强制医疗案件的合议庭均为三人合议庭且合议庭的组成模式具有很大差异性。另外,通过人民法院对适用不同合议庭模式选择可能存在的不足及其原因追溯,可以更有利于强制医疗程序合议庭组成模式的完善。因此,通过从吸收相关专业人民陪审员的必要性、构建“一专多能”法官的培养模式及相关配套辅助人员等方面完善现行合议庭组成模式的不足,力图提出良性配置合议庭人才资源和优化强制医疗案件审理路径的有益思考和见解。
According to the Criminal Procedure Law, for compulsory medical cases, the people’s court should form a collegial panel for trial, but there is no clear regulation on the composition mode of the collegial panel. Based on empirical research conducted by grassroots people’s courts in practice on the composition of the collegial panel for the trial of compulsory medical cases, it has been found that the collegial panel for the trial of compulsory medical cases is a three person collegial panel, and the composition mode of the collegial panel has significant differences. In addition, by tracing the possible shortcomings and reasons for the selection of different collegial panel modes by the people’s court, it can be more conducive to the improvement of the composition mode of the compulsory medical procedure collegial panel. Therefore, by improving the shortcomings of the current collegial panel composition model from the necessity of absorbing relevant professional people’s assessors, constructing a training model of “one expert with multiple abilities” judges, and related supporting personnel, we aim to propose beneficial thoughts and insights on the healthy allocation of collegial panel talent resources and the optimization of the trial path for compulsory medical cases.
