摘要
著作权合理使用是著作权法的基本问题。出版社大面积的引用和参考原作者的作品是否构成适当引用?本案是适当引用的标志。明晰了原作与二作之间的引用是否落在适当引用的范畴中的基本概念。本文以适当引用为核心,以转换性使用以及替代市场作为其构成要件,使得法院在具备逻辑起点的前提下,引入“公平责任”以及“公众合理性认同”以保障著作权人的合法利益。
The protection of the author’s copyright is fundamental in copyright law. If Publisher’s wide range citation and reference of author’s paper work suits the definition of “proper citation”?
