摘要
本文从医疗事故技术鉴定证据基本问题入手,分析医疗事故技术鉴定证据在证据能力上存在的瑕疵,从民事诉讼角度对医疗事故技术鉴定定性为"鉴定结论"的证明力进行审查,并结合相关法律、司法解释的规定,对完善医疗事故技术鉴定证据的立法提出了建议。
This paper proceeded with the basic problems of medical accident technical appraisal evidence and analysed the flaws of the evidence in terms of credibility. It examined the ability of proof of medical accident technical appraisals as 'appraisal conclusions' in the perspective civil action. Suggestions were put forward about legislation improvement in medical accident technical appraisal evidence, based on relevant laws and legislative explanations.
