摘要
《中华人民共和国海商法》(简称《海商法》)及《中华人民共和国物权法》对船舶物权的变动采用登记对抗主义模式,而法律物权与事实物权的区分诠释了挂靠船舶的挂靠人与被挂靠人对船舶的权属。作为事实物权人的挂靠人,其权利应得到法律的保护。通过分析挂靠人提起的合同之诉与侵权之诉,从两方面论述挂靠人得到权利保障的法律途径。在船舶法律物权与事实物权不一致时,在《海商法》下应当对第三人给予保护,基于此提出对《海商法》船舶物权部分的修改建议并提出法律修改建议稿。
The Maritime Code of the People’s Republic of China( CMC) and the Property Law of People’s Republic of China both adopt the mode of registration antagonism regarding the change of ship’s property right. The distinction between legal property right and factual property right interprets the real rights of the affiliat person and the affiliating person of the ship. As the factual real right owner,rights of the affiliated person should be protected by law. This paper discusses the legal approach to guarantee the rights of the affiliated person by analyzing the lawsuit in contract and the lawsuit in tort as brought by the affiliated person. In case of inconsistency between the real right of law and the real right of fact,the third party should be protected under the CMC. Based on this,suggestions on the revision of the real right of ship in the CMC are put forward and the draft amendment is proposed.
