摘要
                
                    体育赛事本身的性质决定了'竞技无版权'。体育赛事网络实时盗播作为一种非法的'转播'形式,成为困扰我国当前体育赛事直播著作权保护的难题。我国当前的司法实践中,多数法院认为体育赛事节目或者直播画面的'独创性'有限,尚未达到作品的要求,但是可以作为录像制品来保护。参照美、日发达国家的做法,未来我国著作权法的发展应是弱化作品的独创性,同时强化作品的实用性和经济性。针对网络实时盗播的不法行为,可以选择扩张广播组织权中的转播权来规制,并且这种扩权具有正当性和合理性。
                
                The nature of the sporting event itself determines that 'No Copyright in Athletics'.The real-time piracy of the sports tournament network is an illegal broadcast form of 'broadcast',which has become a problem that plagued the copyright protection of live sports in our country.In our current judicial practice,most courts consider that the originality of sports events or live screens is limited and has not yet reached the requirements of 'originality' of works,but can be protected as video products.With reference to the practice of the United States and the developed countries,the future development of China’ s copyright law should be weakened works of originality,while strengthening the works of practical and economic.In view of the illegal acts of real-time piracy in the network,we can choose to expand the broadcast right in the broadcasting organization right to regulate,and this kind of right is reasonable and reasonable.
