混合道义论的马克思正义理论批判被引量：3

An Analysis of Marx's Theory of Justice from the Perspective of Mixed Deontology

摘要科恩、杰拉斯和佩弗等西方学者在"塔克尔-伍德命题"的争论中把马克思归类于混合道义论,并形成了理解马克思正义理论的三项共识:正义中心论、自然权利正当论、正义原则普适论,期望以此把马克思带回正义命题。但在马克思看来,分配正义从属于生产正义,离开了生产方式批判资本主义是舍本逐末;自然权利是市民社会的产物,不能用自然权利去奠基正义基础,反而需要经常对其保持意识形态的警惕;反对致力于建立一个以自然权利为基础的普遍适用的正义理论体系,而是应该给予正义观念以历史主义的理解。混合道义论"把马克思主义带回正义命题"的尝试虽然对于建构马克思正义理论具有一定的积极作用,但由于缺乏历史唯物主义的基础,偏离了马克思正义理论的核心范畴,降低了马克思正义理论的阶位,需要给予批判。 Western scholars such as Cohen,Geras,and Peffer classified Marx as'mixed-deontology'in the debate of'Takel-Wood proposition',and formed three consensus on understanding Marx’s theory of justice:the'distributive justice centered theory',the'natural rights justification theory',and the'justice principle universality theory',hoping to bring Marx back to the proposition of justice.However,in Marx’s view,distributive justice is subordinate to productive justice,and criticizing capitalism without the mode of production is an end-to-end choice.Natural rights are the product of civil society.Therefore,instead of laying the foundation of justice by using natural rights,an ideological vigilance should always be kept against it.Opposed to making efforts to the establishment of a universal and applicable theoretical system of justice based on natural rights,a historical understanding of the concept of justice should be adhered to.Although the attempt to'bring Marxism back to the proposition of justice'has a positive effect on the construction of Marx’s theory of justice,yet,due to the lack of historical materialism,it deviates from the core category of Marx’s theory of justice,lowers the rank of Marx’s theory of justice,which should be criticized.
