摘要
"合理便利"起源于20世纪六七十年代美国反就业歧视的法律实践,美国关于"合理便利"的立法为世界范围内"合理便利"的发展树立了典范。加拿大是"合理便利"的另一个发源地。在加拿大,义务主体提供"合理便利"的义务主要是从《加拿大权利和自由宪章》第15条以及联邦和省《人权法案》关于平等权的法律规范中推导出来的。《联合国残疾人权利公约》对"合理便利"概念的定型化具有重要作用,该公约的订立过程更是"合理便利"的含义、特征和保障制度等得以明确的过程。
The concept of 'Reasonable Accommodation ' originated in relation to antidiscrimination in the area of employment in the US law,which eventually became a model lawaround the world.Canada is another 'birthplace' of 'Reasonable Accommodation'.In Canada,the obligation to provide 'Reasonable Accommodation' was basically derived from Article 15 of the Canadian Charter of Rights and Freedoms and those equality rights clauses articulated in federal and provincial Human Rights Acts.The UN Convention on the Rights of Persons with Disabilities has significant influence in defining 'Reasonable Accommodation',because the Convention not only expressly stipulates the concept of 'Reasonable Accommodation ',but also clarifies the meaning,characters and guarantee system of 'Reasonable Accommodation' during the negotiation process of the Convention.
