摘要
在当前中央从严治吏、强力反腐的态势下,行政不作为现象日益增多,值得重视并予以矫治。从行政机关及其工作人员的立场出发,通过分析这些核心行动者决定"作为"或者"不作为"时的现实决策逻辑和行动策略,可以发现在日常的行政执法活动中,行政机关及其工作人员并非机械性的法律执行机器,而会受到法律具体规定、行政内部制度与非制度性因素、社会评价三方面的影响,形成决策的法律逻辑、行政逻辑与社会逻辑。本文试图通过对法律、行政、社会三维行动逻辑的分析,探寻行政不作为的治理路径。
Under the situation that the central government currently administrates the governors strictly and spares no efforts to fight against corruption,administrative omission happens more and more frequent,needing to be focused and handled. From the perspective of administrative organizations and administrative law enforcement officials,by analyzing the realistic decision logic and action strategy adopted when these core actors decide whether they take action or not,we can find that administrative organizations and their officials are not mechanical machines of enforcing laws,but will be influenced by three aspects of legal provision,systematic and non-systematic factors of the administrative organizations and social evaluation during the daily activities of administration and enforcing law,forming the legal,administrative and social of decision-making. This article will seek the governance path of administrative omission through searching on three angles including the law,administration and society.
