摘要
私家车拼车作为一种环保、可持续发展的共享驾乘模式,在实践中却是影响最广、争议最大的领域。本文试图以共享经济为视角,从私家车拼车的形式、拼车的法律关系和驾乘人员之间责任承担几个问题谈起,以期寻找私家车拼车的法治出路。
Private car fight as an environmentally friendly, sustainable development of the shared driving mode, in practice, it is the most widely affected, the largest areas of controversy. This paper attempts to share the economic perspective, from the private car in the form of carpool, the legal relationship between the carpool and the responsibility of the occupants between several issues, in order to find a private car to fight the way out of the rule of law.
