摘要
“协同推进降碳、减污、扩绿、增长”各要素间存在的多层并进逻辑结构,是对其法律制度需求进行分析归纳的基础。“降碳”与“减污”的协同,需要以环境法语境中市场机制与行政管制功能互补的一体化发展为基础,推进碳排放权交易制度与排污许可制度的结构性整合。“降碳、减污”与“扩绿”的协同,需要污染防治立法与生态保护立法的均衡发展予以支持,当前相关研究的重点在于应充分阐明推进生态保护立法的路径选择。“降碳、减污、扩绿”与“增长”的协同,需要推动环境法中环境保护与经济发展的异质性思维向同质性思维转变,并以此为导向构建环境法中的生态产品价值实现机制。
The multi-layered and concurrent logical structure among the elements of“coordinated advancement of carbon reduction,pollution control,ecological expansion,and economic growth”forms the basis for analyzing and summarizing its legal system requirements.The synergy between“carbon reduction”and“pollution control”requires an integrated development approach that combines market mechanisms with administrative regulation in the context of environmental law,promoting the structural integration of carbon emission trading systems and pollution discharge permit systems.The coordination of“carbon reduction,pollution control”with“ecological expansion”necessitates balanced development between pollution prevention legislation and ecological protection legislation.Current research focuses on clarifying the pathwaychoices for advancing ecological protection legislation.The alignment of“carbon reduction,pollution control,ecological expansion”with“economic growth”demands a shift in environmental law from heterogeneous thinking(treating environmental protection and economic development as opposing goals)to homogeneous thinking(recognizing their compatibility).This shift should guide the establishment of an ecological product value realization mechanism within environmental law.
