摘要
随着犯罪行为向虚拟场域转移和各类信息资源的数据化,侦查模式发生了深刻变革,掌握大量网络数据资源的私方数据主体协助侦查的现象增多。私方数据主体协助侦查有利于高质、高效打击犯罪,有利于推进犯罪全球化问题的治理。但是,私方数据主体协助侦查存在侦查权过度外溢、侵犯隐私、泄漏侦查秘密和控辩失衡等风险。因此,应当平衡国家权力与公民权利,在保障犯罪侦查需求与刑诉正当程序价值的基础上,规避私方数据主体协助侦查引发的风险,充分发挥私方数据主体协助侦查的正面效益。
With the transfer of criminal behavior to virtual field and the digitization of various information resources,the mode of investigation has undergone profound changes,and the phenomenon of private data subjects who master a large number of network data resources to assist in investigation has increased.The assistance of private data subjects in investigation is conducive to high quality and efficient crime fighting,and is conducive to promoting the governance of crime globalization.However,there are risks such as excessive spillover of investigation power,invasion of privacy,leakage of investigation secrets and unbalance of prosecution and defense.Therefore,we should balance state power and citizens'rights,avoid the risks caused by the private data subject's assistance in investigation,and give full play to the positive benefits of the private data subject's assistance in investigation on the basis of guaranteeing the needs of criminal investigation and the due process value of criminal proceedings.
