摘要
《监狱法》修订以现代性与前瞻性、政治性、科学性与人文性、规范性与专业性等为价值导向。现代性是监狱治理体系与治理能力建设的必然要求,前瞻性是以监狱的未来发展为导向,政治性是监狱的本质属性,科学性是对《监狱法》修订价值的重要判断标准,人文性是《监狱法》修订所彰显的以人为本的思想,规范性要求《监狱法》修订要遵循法律法规、制度规范和行为规则,专业性是监狱自身所具有的专业特点和风格。《监狱法》修订的价值理念、思维方式、思想体系、制度规范等,代表着中国监狱制度的文明和进步,在一定意义上体现着中国监狱的话语体系,是中国刑事执行制度的文化符号。
The revision of the Prison Law is guided by values such as modernity and forward-lookingness,political nature,scientificity and humanity,standardization and professionalism.Modernity is an inevitable requirement for the construction of the prison governance system and capacity;forward-lookingness is oriented toward the future development of prisons;political nature is the essential attribute of prisons;scientificity is an important criterion for judging the value of the Prison Law revision;humanity highlights the people-oriented thought in the revision of the Prison Law;standardization requires that the revision of the Prison Law follows laws and regulations,institutional norms and behavioral rules;professionalism refers to the professional characteristics and style of prisons themselves.The value concepts,thinking modes,ideological systems,and institutional norms of the Prison Law revision represent the civilization and progress of China's prison system,reflect the discourse system of Chinese prisons to a certain extent,and are the cultural symbols of China's criminal execution system.
