摘要
改革开放以来,基于特殊的发展目标和制度安排设立的大量特殊经济区域,是我国推进改革、法治与发展历程的缩影,对其可在“地理—经济—制度”的“三维分析框架”下展开解析。鉴于特殊区域受制度因素影响更大,其制度差异关乎区域协调发展和全国统一大市场建设,对其制度竞争尤其应当加强法律规制。为此,应依据《立法法》规定,解决有关特殊区域的授权立法、暂时调整法律适用和自定规则方面的法治问题,并从竞争法、财税法等多个维度,加强对特殊区域制度生成和制度竞争的法律约束,从而通过提升制度品质,推进各类区域之间的良性制度竞争。解析“特殊区域—制度差异—制度竞争—法律规制”的内在关联及相关法律问题,不仅有助于揭示“经济改革—特殊区域—制度试点—制度推广”这一贯穿我国经济改革和法制建设的重要主线,也有助于明确完善特殊区域制度的方向,提升整体经济法治的水平,并由此进一步提炼“特殊区域法治理论”,丰富和完善经济法治理论。
Since the reform and opening-up,a large number of special economic regions have been set up on the basis of special development goals and institutional arrangements,which are the epitome of the reform,the rule of law and the development process in our country.Therefore,they can be analyzed under the“three-dimensional analytical framework”of“geography—economy—system”.As the special regions are more influenced by institutional factors and the institutional differences involve the coordinated regional development and the construction of a unified market,it is necessary to strengthen the legal regulation of institutional competition in such regions.Therefore,we should,in accordance with the Legislation Law,solve the problems concerning the rule of law in terms of authorized legislation,temporary adjustment of the legal application and voluntary rules in special regions,and strengthen the legal constraints on the institutional generation and institutional competition in special regions from the perspectives of competition law,fiscal and tax law,etc.,so as to improve institutional quality and promote benign institutional competition among various kinds of regions.Analyzing the internal relations and related legal issues of“special region—institutional difference—institutional competition—legal regulation”will help to reveal the main line of“economic reform—special region—institutional pilot—institutional extension”,which runs through our economic reform and legal construction.This analysis will also help to clarify the direction to improve the special regional system,enhance the level of the overall economic rule of law,and further refine the“theory on the rule of law in special regions”to enrich and improve the theory of economic rule of law.
