摘要
构建国际商事仲裁中心是我国促进涉外民商事争议解决发展的重要一环,是涉外法治在争议解决领域的具体抓手之一。意思自治是商事仲裁制度的基石,意思自治的保障与限制是商事仲裁制度发展过程中的一对主要矛盾与次要矛盾。《仲裁法》的修改要树立系统思维,既要抓住意思自治保障这一主要矛盾,同时也不能忽视如何适当规范意思自治这一次要矛盾,避免次要矛盾制约主要矛盾的解决。完善仲裁意思自治限制规定不是要开倒车,而是要通过厘清现有限制规则,清除不合理的限制,完善必要的限制,曲中求直促进意思自治保障的落实。我国商事仲裁意思自治限制机制的完善问题来自于历史,扎根于中国,面向着实践,落脚于实现。当前《仲裁法》修改应以可仲裁性、公共政策以及强制性规范三方面的限制规则为着力点,通过明确限制事由、规划限制范围以及拟定限制标准等方式完善意思自治限制机制。
Party autonomy is the cornerstone of international commercial arbitration.The protection and limitation of party autonomy represent the primary and secondary contradictions in the development process of the international commercial arbitration system.The revision of the“Arbitration Law”should adopt a systematic approach,addressing both the primary contradiction of ensuring party autonomy and the secondary contradiction of its limitations,to prevent the secondary contradiction from hindering the resolution of the primary one.Improving the mechanism for limiting party autonomy in arbitration is not about regressing,but involves clarifying existing rules,removing unreasonable restrictions,and enhancing necessary limitations,thereby indirectly promoting the implementation of party autonomy.The improvement of the mechanism for limiting party autonomy in China's international commercial arbitration stems from historical development,is rooted in China,faces practical challenges,and aims at effective implementation.The current revision of the“Arbitration Law”should focus on the limitations of arbitrability,public policy,and mandatory norms,and improve the mechanism for limiting party autonomy through clarifying reasons for limitations,planning the scope of limitations,and formulating standards for limitations.
