从体系完善到效能转化:党内法规制度建设重心的转变

From System Improvement to Efficacy Conversion:The Shift in Focus of the Institutional Con-struction of Intra-Party Rules and Regulations

摘要体系完善与效能转化是党内法规制度建设的双重目标指向。以体系完善为重心的党内法规制度建设成效显著,形成了比较完善的党内法规体系,为依规治党和依法执政提供了有力保障。然而,以体系完善为重心的党内法规制度建设也存在相应问题,如地方党内法规数量庞大但作用发挥有限、党内法规实施相关机制不健全或者适用不足影响了治理效能的转化以及人民群众参与的积极性有待提高等。为此,有必要及时转变党内法规制度建设的重心,通过着力于组织机构的调整或设立、着力于相关机制的健全和适用,实现制度建设重心由体系完善转变为效能转化。在这一过程中,还需处理好体系完善与效能转化、党内法规政治性与规范性、党内治理和社会治理以及制度建设的封闭性与开放性这四组关系。 The system improvement and efficacy conversion are the dual goals of the institutional con‐struction of intra-Party rules and regulations.The institutional construction of intra-Party rules and regulations with a focus on improving the system has achieved significant results,forming a relatively complete system of intra-Party rules and regulations,and providing strong guarantees for the rule-based governance over the Party and the law-based exercise of state power.However,there are also corresponding problems in the institutional construction of intra-Party rules and regulations with a focus on system improvement,such as the large number of local Party regulations but limited effectiveness,the incomplete or inadequate implementation mechanisms of Party regulations affecting the transformation of governance efficiency,and the need to improve the enthusi‐asm of the people’s participation.Therefore,it is necessary to timely shift the focus of the institutional con‐struction of intra-Party rules and regulations,by focusing on the adjustment or establishment of organizational structures and the improvement and application of relevant mechanisms,to achieve the transformation of the fo‐cus of institutional construction from system improvement to efficiency conversion.In this process,it is also necessary to handle four sets of relationships:system improvement and efficiency conversion,political nature and normative nature of the intra-Party rules and regulations,Party governance and social governance,and the closedness and openness of institutional construction.

作者简介陈光,法学博士,辽宁师范大学法政学院教授、院长、博士生导师,大连市监察官学院副院长,加拿大萨斯喀彻温大学访问学者,大连市第一届优秀青年法学法律专家,2024年中国知网高被引学者TOP1%。兼任中国法学会立法学研究会理事、中国科学技术法学会理事、辽宁省法学会法理学研究会副会长、宪法行政法学研究会副会长、法律逻辑学证据学研究会副会长和大连市人大常委会地方立法专家顾问等。主要从事立法学、法律社会学和党内法规学研究。主持完成国家社科基金项目、教育部人文社科基金项目和辽宁省社科基金项目等省部级以上课题7项,出版《区域立法协调机制的理论建构》《法治社会与社区治理多元规范》《党内法规的基层治理效能》等专著5部,主编或参编《宪法与行政法学》《立法学原理》《法社会学专论》等教材6部,在《东方法学》《法治日报》等期刊或报纸发表学术论文80余篇,其中多篇文章被全文转载。
