摘要
模糊是自然界与人类社会之共有现象,也是党内法规的突出特点之一。其既是客观存在的,又有主观赋予;既是应然需要的,又有实然表现。对其有效的研究可分析出党内法规表达规律、参透党内法规的特有属性,有助于提高党内法规立规的技术、质量和水平。党内法规的模糊性与政治性、思想性、规范性、强制性有基本逻辑关联;在宏观、微观方面都有典型表现并可以总结判定的标准。语言固有属性、抽象概括的辐射需要、党言党语独具的特色、立规技术漏洞等,导致党内法规带有一定的模糊性。确定适度边界、统筹法规资源、健全解释机制、规范立法技术等,是调适党内法规模糊性的几个方法。
Vagueness is a common phenomenon in the natural and social world,it is also one of the prominent characteristics of inner-Party laws and regulations,which is both objective and subjective,both necessary and practical.Effective study on it can reveal the expression rules and unique attributes of inner-Party laws and regulations,and help to improve the technology,quality and level of the formulation of inner-Party laws and regulations.The vagueness of inner-Party laws and regulations is logically related to politics,ideology,normalization and compulsion.It has typical performance in macro and micro aspects,and can summarize the criteria for judgement.The causes of vagueness include the inherent attribute of language,the radiation need of abstract summary of Party regulations,the unique characteristic of Party language,the technical loophole of formulation and other factors.The determination of appropriate boundary,the overall arrangement of regulatory resources,the improvement of interpretation mechanism and the standardization of formulation technology are several methods to adjust the vagueness of inner-Party laws and regulations.
