摘要
美丽中国建设目标要求持续深入推进污染防治攻坚,新污染物环境风险有效管控是新污染物治理初期亟待解决的问题。环境风险评估是新污染物环境风险管控的核心,关系到管控目的能否实现。检视当前新污染物环境风险评估法律框架,存在全生命周期管理制度链条断裂、风险预防原则贯彻不足、专门性立法缺失等问题。应以全生命周期管理补强末端治理,从损害预防转向风险预防,重点完善风险评估专门立法,并借助“生态环境法典”编纂统筹表达,构建科学的风险评估制度。
The goal of building a beautiful China requires continued in-depth promotion of pollution prevention and control,and the effective control of environmental risks of emerging pollutants is an urgent problem in the early stages of emerging pollutant management.Environmental risk assessment is the core of environmental risk control of emerging pollutants,which is related to whether the purpose of control can be realized.Reviewing the current legal framework for environmental risk assessment of emerging pollutants,there are problems such as the broken chain of the whole life cycle management system,insufficient implementation of the principle of risk prevention,and the lack of specialized legislation.It is necessary to strengthen end-of-life management with whole-life management,shift from damage prevention to risk prevention,focus on improving specialized legislation on risk assessment,and build a scientific risk assessment system with the help of the codification of the environmental code.
