摘要
人类面临百年未有之大变局之际,中国政府提出构建涉外法治的理念。法律为法治之主要内容,而法律必以其本民族的文化为基础,反映其价值。《易》是中华文化的源头,被儒家尊为五经之首,被道家奉为三玄之冠,亦为诸子百家之源,对中华文化乃至人类文明之发展做出了重要贡献,也为构建涉外法治提供了哲学与文化的基础。涉外法治之构建应以吸引外资和促进对外经贸关系为近期目标,以实现宇宙的万物和谐为终极目标,近期目标为实现终极目标的过程与必要条件。“万物负阴而抱阳”,构建涉外法治必有推力与阻力,然正如《易》所反映的以阴阳为标示的宇宙规律所揭示,阴阳或推力与阻力是一个事物的两个方面,相互作用、相互感应、相互依存、相互转化。阴阳相互激荡是事物发生发展的过程或流行,为实现涉外法治的预期目标,人们必须固守正道,坚持诚信原则,不断累积信誉,努力争取世人的支持,以惠及人类。
At atimewhen humanity isconfronted withunprecedented changesin acentury,theChinese government has put forward the concept of building a rule of law framework in matters involving foreign parties("RLF"').Law constitutes the fundamental content of the rule of law,and it is grounded in the culture of its own nation and reflects its values.The Yi Jing stands as the origin of Chinese culture,esteemed by Confucianism as the foremost of the Five Classics and venerated by Daoism as the pinnacle of the Three Profundities.It also serves as the source of the hundred schools of thought in ancient China.Yi Jing has made profound contributions to the advancement of the Chinese culture as well as the human civilization and provides a philosophical and cultural basis for formulating the RLF.The construction of the RLF should aim at attracting foreign investment and promoting foreign economic and trade relations as its immediate objective;its long-term goal should be for the harmonization of all things in the universe.The immediate objective serves as both the process and necessary conditions for achieving the long-term goal.All things are governed by the interplay of yin and yang.The construction of the RLF is bound to have driving forces and resistances.However,as the cosmic principle-represented by yin and yang-of Yi Jing illustrates,yin and yang as well as the driving forces and resistances are two sides of the same coin;they mutually interact on each other,mutually induct each other,mutually depend on each other,and mutually transform each other.The interaction of yin and yang is the process or the flow of happening of the coming into being and growth of a thing.To achieve the anticipated goals of the RLF,it is essential to remain steadfast in the pursuit of righteousness,uphold the principle of good faith,continuously cultivate trust and integrity,and earnestly seek the support of the global community,thereby contributing to the welfare of the humankind.
