摘要
企业刑事合规在多个国家和地区已经予以立法规定或实施,已然取得了较大的成果。但是由于企业刑事合规的设计及制度成本等问题,该制度实施主要针对大型企业。应当以我国中小企业为适用主体,探究如何将刑事企业合规制度进行具体构建,使相关的政策福利惠及每一个中小企业。为此,需要从国家主导、大型企业指导、行业构建、个体引用及个体反馈的后续修正等方面,推动构建合规方案“从上至下”的建立机制与“从下至上”的完善机制,共同推动我国中小企业刑事企业合规建设与运行的长效机制。
Enterprise criminal compliance has been legislated or implemented in multiple countries and regions,and significant achievements have been made.However,due to issues such as the design and institutional costs of corporate criminal law,the implementation of this system mainly targets large enterprises.We should focus on small and medium-sized enterprises in our country and explore how to specifically construct a criminal enterprise compliance system,so that relevant policy benefits can benefit every small and medium-sized enterprise.To this end,it is necessary to promote the establishment of a“top-down”mechanism and a“bottom-up”improvement mechanism for the construction of compliance plans from the aspects of national leadership,and these machanism should be aided by guidance from large enterprises,industry construction,individual citation,and subsequent correction after individual feedback.Only in this way,can we jointly promote the long-term mechanism of compliance construction and operation of criminal enterprises in China's small and medium-sized enterprises.
