摘要
中国古代针对犯罪行为会进行刑罚处置,刑罚是古代诉讼和审判程序后重要的司法执行程序,由此刑罚制度是古代司法制度中的重要组成部分。有金一代刑罚体系亦继承和兼采前代制度传统,并逐步发展为具有本朝特质的刑罚制度。金代刑罚制度研究是金代司法研究的重要内容之一,自20世纪以来,尤其是20世纪80年代后,国内学界围绕金代刑罚制度中的刑罚种类方式、犯罪与刑罚执行措施、刑罚执行特征等诸多方面进行研究,已取得较为丰硕的研究成果。该文对金代刑罚制度研究现有成果进行梳理归纳,并作简要评述,以期了解金代刑罚制度研究的现状,促进金代司法研究的发展。
In ancient China,criminal acts would be dealt with by punishment.Punishment was an important execution procedure after the ancient litigation and trial judicial procedures,so the penalty system was an important part of the ancient judicial system.The penalty system of the Jin generation also inherited and adopted the system tradition of the previous generation,and gradually developed into a penalty system with the characteristics of the dynasty.The study of penalty system in Jin Dynasty is one of the important contents of judicial research in Jin Dynasty.Since the 20th century,especially after the 1980s,domestic academic circles have studied the penalty types,crime and penalty execution measures,penalty execution characteristics and many other aspects of the penalty system in Jin Dynasty,and have achieved fruitful research results.On the basis of the previous studies,this paper summarizes the existing results of the Jin Dynasty penal system research,and makes a brief comment in order to understand the current situation of the Jin Dynasty penal system research and promote the development of the Jin Dynasty judicial research.
