摘要
判词在古代诉讼中相当于现在法院的裁判文书。唐代判词具有以情理说服和说理透彻两大特点,且具有较高的文学价值。由于我国目前的裁判文书具有格式刻板且说理不透、文采不足和缺乏情理等问题,而唐代判词注重以情说理、以典故说理、以道德说理和以文化说理,对我国裁判文书改革具有良好的借鉴意义。建议通过优化法律表达方式,学习唐代判词的逻辑清晰、寓情于理的表达方法,凸显法官的司法智慧等途径助力我国裁判文书改革。
Verdicts in ancient litigation served as the equivalent of modern courts'judgment documents.Tang Dynasty verdicts were characterized by persuasive emotional appeals and thorough reasoning,and also possessed significant literary merit.Given the issues in China's current judicial documents—such as rigid formatting,unclear reasoning,lack of literary grace,and absence of emotional reasoning—the Tang Dynasty's emphasis on reasoning with emotion,allusions,morality,and culture offers valuable insights for the reform of China's judicial document reforms.It is advisable to enhance legal expression methods,adopt the logical and emotional expression of Tang Dynasty verdicts,and emphasize the judicial wisdom of judges to aid in the reform of China's judicial documents.
