涉外法治人才培养背景下“国际法不确定性”对国际法教学的启示

The Enlightenment of Indeterminacy of International Law on the International Law Teaching in the Background of Cultivating Foreign-related Legal Talent

摘要 国际法不能为具体案件提供唯一、正确的答案,被称为“国际法不确定性”,主要体现为国际法语言的开放模糊,而且国际法规则系统外的国际法体系化缺失、国际法参与者对国际法的主观建构都是“国际法不确定性”的因素。“国际法不确定性”要求国际法教学能服务于解决现实问题,这契合涉外法治人才培养目标,在认识国际法层面上,避免国际法万能论或国际法虚无论的陷阱。由此,国际法教学应揭示并回应“国际法不确定性”。在理论教学方面,国际法课程以应用为目标且以国际法渊源为基础架构教学内容,培养国际法的论辩思维;在国际法教学中运用交叉学科知识或单独设置交叉学科课程,助益于理解他者对国际法的影响。在实践教学方面,案例教学法可运用于国际法课程教学中,也可以单独设置国际法案例课程,该课程与国际模拟法庭、涉外法律诊所等实践课程一起以真实的情境呈现“国际法不确定性”。 International law cannot provide a unique and correct answer for a specific case,which is called indeterminacy of international law.This is mainly reflected in the openness and ambiguity of international law language,the fragementation of international law and the construction of international law by international legal participants.Indeterminacy of international law requires that international law teaching can serve to solve practical problems,which is in line with the goal of cultivating foreign-related legal talent.In terms of understanding international law,it avoids falling in the trap of omnipotence of international law and futility of international law.Therefore,the teaching of international law should reveal and respond to indeterminacy of international law.In theoretical teaching,the international law course aims at application and its content should be based on the source of international law in order to cultivate the argumentative thinking of international law.Applying interdisciplinary knowledge or separately setting up interdisciplinary courses is conducive to understand and grasp the influence of others on international law.In practical teaching,the case-study method can be used in international law courses,or the international law case course can be set up separately,along with the practical courses such as international moot courts and foreign-related legal clinics,these courses present indeterminacy of international law in a real situation.
