摘要
党的二十大报告提出了“加强文物和文化遗产保护力度”的要求。包括生态环境保护在内的大运河文化保护是文化遗产保护的重要内容。文化保护,法治先行,法治方法是大运河文化保护的直接、有效方式。因此,通过地方立法将大运河文化遗产保护纳入法治轨道是加强大运河文化保护的关键。目前,大运河流域部分省、市已经出台的相关地方法规,为区域大运河文化保护和开发、利用提供了法律依据,但河南省及相关地市关于大运河文化保护的地方立法工作不够及时,未能形成大运河文化保护的法律支撑。因此,立足河南省及相关地市大运河保护的实际及需求,探索推动省市立法,加强大运河文化保护和开发利用。
The report of the 20th National Congress of the Communist Party of China calls for "strengthening the protection of cultural relics and cultural heritage",including the protection of cultural heritage such as the Grand Canal.The legal protection of cultural heritage is an important aspect of cultural heritage protection.The legal approach is a direct and effective way to protect the Grand Canal culture.Therefore,it is crucial to incorporate the legal protection of Grand Canal cultural heritage into the legal orbit through local legislation.Currently,some provinces and cities in the Grand Canal watershed have already issued relevant local laws and regulations,providing a legal basis for regional Grand Canal cultural heritage protection,development,and utilization.However,the local legislative work on Grand Canal cultural heritage protection in Henan Province and related cities is not timely enough to form a legal support for Grand Canal cultural heritage protection.Therefore,based on the actual needs and requirements of Grand Canal protection in Henan Province and related cities,it is important to explore and promote provincial and municipal legislation to strengthen the protection and development and utilization of Grand Canal culture.
