摘要
新修订的《著作权法》增加了著作权侵权物司法处置的规则,原则上赋予著作权人销毁著作权侵权物的请求权。除了知识产权请求权和侵权责任的解释路径外,添附理论也可以成为著作权侵权物司法处置的学理解释。在理论体系的一致性上,适用对象、意思表示、过错、与侵权行为的关系、法律后果等方面,添附理论都具有较大的兼容性,其解释著作权侵权物是可行的。著作权人原则上可以通过添附理论取得著作权侵权物的所有权,实现物尽其用,避免了销毁的浪费;著作权人不能通过添附取得所有权的情形则构成了著作权法第54条第5款规定的“特殊情况”,从而予以明确;著作权人取得所有权后,也可以同时适用物权制度中无权处分与善意取得的规则,从而保障著作权侵权物使用者期待的交易安全;相较于知识产权请求权和侵权责任的学理解释,添附理论可以在不减少行为人利益的前提下,扩大著作权人的权利范围。虽然添附理论解释著作权侵权物不是著作权法所必须的,但其作为一种学理解释,可以较好避免添附理论在知识产权法中适用的局限,同时也对著作权侵权物司法处置的完善有较多的积极意义。
The new Copyright Law has added rules for judicial disposal of copyright Infringing Articles.Copyright owners can generally request the destruction of copyright infringing articles.Besides IP claim and torts,accessio theory can also be a theoretical explanation for the judicial disposal of copyright infringing articles.In the applicable objects,expression of intent,fault,relationship with infringement and legal consequences,accessio is highly compatible and can explain the legal rules of copyright infringing articles.In principle,the copyright owner can obtain the ownership of the copyright infringing articles through the accessio theory,realize the best use of the material,and avoid the waste of destruction.If the copyright owner cann’t obtain the ownership,then this situation constitutes a"special situation"stipulated in Article 54(5)of the new Copyright Law.The rules of unauthorized disposition and bona fide acquisition can also protect the security of transactions expected by users of copyright infringing articles.Compared with IP claim and torts,accessio can expand the scope of copyright,without reducing the interests of the infringer.Although the accessio explanation of copyright infringement is not required by the copyright law,as a theoretical explanation,it can better avoid the limitation of accessio in the application of IP.It has more positive significance for the perfection of judicial disposal of copyright infringing articles.
