摘要
在全面依法治国的大背景下,党建引领基层治理也要与之相适应,努力实现党的自身建设和基层治理两个层面的法治化重塑,以此来实现基层治理体系和基础治理能力的现代化。如何把握党建引领基层治理的内在逻辑和法治原理,寻求与中国国情和发展现状相适应的建设路径,就成为中国式现代化进程中党和人民必须直面的时代课题。“元治理”理论能为党建引领基层治理法治化提供一种解释框架,它能够适应党的领导和依法治国双重需求,对实践具有解释力,还能为推进党和国家治理能力和治理体系现代化提供方法论。在中国特色社会主义伟大实践中,能够担任“元治理”这一角色,对治理进行治理的,唯有中国共产党及其领导的国家机关,也就是党和政府。党建引领基层治理的法治化牢牢把握住了中国特色社会主义国家治理的核心和关键——中国共产党的领导,强调发挥“元治理”主体中国共产党的作用,要求按照法治化的方式,统筹协调并发挥其他治理资源和模式的优势,促进协同共治,实现基层治理的总目标。这个过程中,党是基层“元治理”的核心主体,党建是基层“元治理”的基础资源,依法治理是基层“元治理”的必然选择。党建引领基层治理法治化包含了国家和党内法治的双重意涵,以及完善的党内法规体系和国家法律体系的双重要求。党建引领基层治理是中国社会治理实践的重要探索和鲜明特征,集中发挥和充分展现了中国特色基层治理制度的优势,是我国新时代推进基层治理体系和治理能力现代化的重要抓手。基层社会的长久高效治理目标的实现,需要依靠稳固的制度来保障,特别是用法治化的方式释放党建引领基层治理的制度潜力与实践效能,推动基层治理体系和治理能力的现代化,确保实现良法善治。所以,推进党建引领基层治理迈向法治化的关键在于坚持党的领导并用法治的方式将之具体化,根本路径是协同推进国家法治与党内法治,基本依托是完善党内法规与国家法律制度体系。
Under the background of comprehensively governing the country according to law,primary level governance through Party building should also adapt to it,and strive to realize the legal reshaping of the Party's self-construction and primary level governance,so as to realize the modernization of primary level governance system and basic governance ability.How to grasp the inherent logic of primary level governance through Party building leading and the principle of the rule of law,and how to seek a construction path suitable to China's national conditions and development situation have become an issue of the times that the Party and the people must face directly in the process of Chinese-type modernization.The theory of"meta-governance"can provide an explanatory framework for the Party building to lead the legalization of primary level governance.It can meet the dual needs of the Party's leadership and governing the country according to law,and has the power to explain the practice.It can also provide methodology for promoting the governance ability of the Party and the state and the modernization of the governance system.In the great practice of socialism with Chinese characteristics,only the Communist Party of China and the state organs under his leadership,i.e.the Party and the government,can play the role of"meta-governance".The rule of law of primary level governance through Party building firmly grasps the core and key of socialist national governance with Chinese characteristics—the Communist Party of China's leadership,emphasizes giving full play to the role of the Communist Party of China,the subject of"meta-governance".It is required to coordinate and give full play to the advantages of other governance resources and models,promote coordinated and cogovernance,and achieve the overall goal of primary level governance.In this process,the Party is the core subject of primary"meta-governance",Party building is the basic resource of primary"metagovernance",and governance according to law is the inevitable choice of primary"meta-governance".The rule of law at the primary level governance through Party building contains the dual meaning of the state and the rule of law within the Party and the dual requirements of perfecting the Party rules and state law system.The primary level governance through Party building is an important exploration and distinct feature of China's social governance practice,which focuses on and fully shows the advantages of primary level governance system with Chinese characteristics,and is an important starting point for China to promote the modernization of primary level governance system and governance capacity in the new era.The realization of the goal of long-term and efficient governance of primary society needs to be guaranteed by a solid system,especially by releasing the institutional potential and practical effectiveness of the primary level governance through Party building in the way of the rule of law to promote the modernization of primary level governance system and governance ability and to ensure the realization of good law and good governance.Therefore,the key to promoting the primary level governance through Party building towards the rule of law is to adhere to the Party's leadership and specify it by the way of the rule of law,and the fundamental path is to jointly promote the national rule of law and the inner-Party rule of law.The basic support is to improve the inner-Party laws and regulations and the national legal systems.
