摘要
行政执法与刑事司法在行为规制上的交叉与竞合,决定了二者存在相互衔接的问题。推进行政执法与刑事司法有机衔接的关键则是设置科学合理的案件移送标准。当前我国立法中规定的“涉嫌犯罪”案件移送标准过度限缩了行政执法机关的裁量权,致使执法机关面临着机械化案件移送和惯性违法的两难困境。事实上,刑事不法与刑罚处罚并非全然对应,实践中很多涉嫌犯罪的轻微违法行为并不具有移送司法的必要性。因此,应当赋予行政执法机关案件移送必要性的裁量权,确立“需要追究刑事责任”的案件移送标准,从而保证案件移送的合理性和合法性。
The cross and competition between administrative law enforcement and criminal justice in behavior regulation determines the problem of convergence.The key to promoting the organic connection between administrative law enforcement and criminal justice is to set up scientific and reasonable standards for case transfer.At present,the standards for transfer of"suspected criminal"cases stipulated in Chinese legislation limit the discretion of administrative law enforcement agencies,which makes law enforcement agencies face the dilemma of mechanized case transfer and inertia violation.In fact,criminal wrongfulness and punishment are not exactly corresponding,and many minor illegal acts suspected of crimes in practice are not necessary to be transferred to justice.Therefore,administrative law enforcement agencies should be given necessary discretion of case transfer,and the standards of case transfer that"criminal responsibility needs to be investigated"should be established,so as to ensure the rationality and legitimacy of case transfer.
