摘要
碳排放权质押担保是由金融机构推出的一种新型融资授信模式,也是绿色金融体系下控排主体对低成本市场化减排道路的有益探索。当前碳排放权质押融资实践存在较大的法律风险。在碳排放权质权的设立方面,存在碳排放权法律属性不明、碳排放权质押公示规则不一以及缺少立法支撑的问题;在碳排放权质权的实现方面,存在碳配额价值减损与司法保障机制不足的问题。对此,在制度设计上,应从碳排放权的私权本质入手,明确碳排放权的准物权定位,将其纳入权利质权的客体范围。同时,从统一碳排放权质权公示手段、强化碳排放权质权的司法实现途径来构建和完善碳排放权质押融资法律机制。
The pledge guarantee of carbon emission rights is a new financing credit model introduced by financial institutions,and it is also a beneficial exploration of the main body of emission control for low-cost market-oriented emission reduction under the green financial system.At present,there are great legal risks in the practice of carbon emission pledge financing.In the establishment of the pledge of carbon emission rights,there are some problems,such as the unclear legal attribute of carbon emission rights,the different rules of publicity of carbon emission rights pledge and the lack of legislative support.In the realization of the pledge of carbon emission rights,there are problems such as the loss of carbon quota value and the lack of judicial guarantee mechanism.In this regard,in the system design,we should start with the private nature of carbon emission right,make clear the quasi-real right orientation of carbon emission right,and bring it into the object scope of right pledge.At the same time,the legal mechanism of carbon emission pledge financing should be constructed and improved by unifying the publicity means of carbon emission pledge and strengthening the judicial realization of carbon emission pledge.
