摘要
地域文化是地理标志的重要意涵,对地理标志的保护实质上也是对地域文化的传承和发展,地理标志对地域文化的价值日渐凸显。地理标志的商标法保护模式和专门法保护模式之争本质上是传统手工业和现代工业化的生产模式之争,模式的选择直接决定了地理标志的保护程度和价值实现。我国现已形成的“两种制度、三套体系”的地理标志保护模式存在诸多缺陷,由此导致地理标志无法得到有效保护,进而影响地域文化的发展。为了更好地提升地理标志的文化价值,我国应明确地理标志保护的价值导向为公共利益优先并据此制定地理标志专门法,加强地理标志的顶层设计,构建协调统一的地理标志保护制度。
Regional culture is a significant determinant of geographical indications.In essence,the protection of geographical indications is also the inheritance and development of regional culture.The value of geographical indications to regional culture is becoming increasingly prominent.The dispute between trademark law protection mode and special law protection mode of geographical indications is essentially a dispute between traditional handicraft industry and modern industry.The choice of mode directly determines the protection degree and value realization of geographical indications.There are many deficiencies of the“two systems and three laws”protection mode of geographical indications that has been formed in our country.As a result,geographical indications cannot be effectively protected,and then affect the development of regional culture.In order to better realize the cultural value of geographical indications,China should make it clear that the value orientation of geographical indications protection is the priority of public interests.On this basis,we should formulate a special law on geographical indications,strengthen the top-level design of geographical indications system,and build a coordinated and unified geographical indications protect ion system.
