摘要
随着法治建设的逐渐完善,传统的“打”、“砸”、“抢”等硬暴力手段逐渐减弱,而黑恶势力利用软暴力手段进行为非作恶不断增强。司法机关也为此出台了相关法律文件,明确了“软暴力”的概念和表现形式等,为具体司法工作提供了法律依据。但是在实践过程中发现,尚存在“软暴力”行为认定标准模糊、证据收集困难和危害结果难以量化等难题。为了破除司法实践难题,结合司法工作实际情况,从软暴力行为的概念界定出发,分析软暴力行为在司法实践中存在的难点问题,并针对其提出有针对性的侦查取证策略和措施,以服务于基层司法实践工作。
With the gradual improvement of the construction of the rule of law, the traditional hard violence means such as “beating”, “smashing” and “looting” are gradually weakened, while the evil forces’ use of soft violence means to do evil is increasing. To this end, the judicial organs have also issued relevant legal documents, clarifying the concept and expression form of “soft violence”, and providing a legal basis for the specific judicial work. However, in the process of practice, it is found that there are still difficult problems, such as fuzzy identification criteria of “soft violence” behavior, difficulty in collecting evidence, and difficult quantification of harm results. In order to break the problems of judicial practice,combined with the actual situation of judicial work, the study starts from the concept definition of soft violence, analyzes the difficulties of soft violence in judicial practice, and puts forward targeted investigation and evidence collection strategies and measures, so as to serve the grass-roots judicial practice.
