摘要
科学数据安全责任是保障科学数据安全的基础。科学数据安全责任是责任主体在收集、存储、使用、加工、传输、开放共享和销毁科学数据中必须承担的责任,该责任以“六性”为要求,主体必须避免因为故意或过失而使科学数据遭遇静态风险或动态风险。科学数据安全责任由先定义务和事后责任两个层次构成,违背先定义务就会引发事后责任。科学数据安全责任主体履行安全责任要遵循关于安全保护义务的法律规定,并将“六性”贯穿于整个保护过程中,如果侵害个人、组织、社会和国家的权益、利益则要分别承担民事责任、行政责任和刑事责任,因此,科学数据安全责任主体在履行先定义务时要时刻注重保护个人的、集体的、社会的和国家的数据利益。
The responsibility of scientific data security is the basis of ensuring scientific data security.The responsibility of scientific data security is the responsibility that the responsible subject must bear in the collection, storage, use, processing, transmission, open sharing and destruction of scientific data.The responsibility takes “six characteristics” as the requirements, and the subject must avoid static or dynamic risks of scientific data due to intention or negligence.The responsibility for scientific data security consists of two levels: pre-determined obligation and post-responsibility.Breach of pre-determined obligation will lead to post-responsibility.The subject responsible for scientific data security shall comply with the legal provisions on security protection obligations when performing its security responsibilities, and shall apply the “six characteristics” throughout the whole protection process.If it infringes upon the rights and interests of individuals, organizations, society and the state, it shall bear civil responsibility, administrative responsibility and criminal responsibility respectively.Therefore, the subject responsible for scientific data security shall always pay attention to protecting individual, social and national data interests.
