全民所有自然资源资产损害赔偿定位问题研究被引量：22

摘要在生态环境损害赔偿制度背景下探索全民所有自然资源资产损害赔偿意义重大。文章基于全民所有自然资源资产委托代理具体内容,解决生态环境损害赔偿制度中全民所有自然资源资产经济价值不能实现、所有者权益得不到维护等问题,提出采用生态环境损害赔偿程序实现全民所有自然资源资产生态价值,依据民事领域侵权责任相关规定维护全民所有自然资源资产所有权人的所有者权益。同时,提出建立全民所有自然资源资产损害赔偿鉴定评估体系,将全民所有自然资源资产损害赔偿鉴定评估从生态环境损害赔偿鉴定评估中独立出来,为自然资源部门履行所有者职责提供支撑。 It is of great significance to explore the compensation for damage to natural resource assets ownership by the whole people under the background of compensation system for ecological and environmental damage.Based on the specific content of the principal-agent of natural resource assets ownership by the whole people,this paper addresses the problems such as the economic value of natural resource assets ownership by the whole people cannot be realized,rights and interests of the owners cannot be maintained in the compensation system of ecological and environmental damage,this paper proposes to adopt the ecological compensation procedure to realize the ecological value of natural resource assets ownership by the whole people,to protect the owner's rights and interests of the owner of natural resource assets ownership by the whole people in accordance with the relevant provisions on tort liability in the civil field.At the same time,this paper proposes to establish a system of appraisal and assessment of compensation for damage to natural resource assets ownership by the whole people,which will be independent from the appraisal and assessment of ecological environment damage compensation,so as to provide support for the natural resource departments to fulfill their duties as owners.
