我国残疾人按比例就业制度的法律保护现状与对策

摘要 就业是残疾人融入社会并实现自身价值的有效途径,残疾人作为特殊的困难群体,其就业权得到了国家的特别关注与保护。随着时代的发展,残疾人就业权的内容从以物质救济为基础的生存保障型扩展到以进入劳动力市场实现就业的社会融入型,残疾人就业环境得到了极大改善。但是,目前我国残疾人按比例就业制度的法律保护在国家立法、政府服务、司法救济等层面还存在一些不足,对残疾人就业产生了“挤出效应”。为此,建议从立法、行政、司法这三个方面完善相关法律制度,促进残疾人参与并融入社会,推动残疾人就业保障体系再上新的台阶。 Employment is an effective way for persons with disabilities to integrate into society and realize their own value. As a special disadvantaged group, the right of employment of the disabled has been given special attention and protection by the state. With the development of the times, the content of the employment right of the disabled has been expanded from the subsistence guarantee based on material relief to the social integration based on entering the labor market, and the employment environment of the disabled has been greatly improved. However, at present, the legal protection of the proportional employment system for the disabled in China is in the realistic predicament of national legislation, government service and judicial relief, which produces “crowding-out effect”. Therefore, it is suggested that the relevant legal systems should be improved from the legislative, administrative and judicial aspects to promote the participation and integration of the disabled into society, and promote the employment security system for the disabled to a new level.
