摘要
人口老龄化已经是不可否认的事实,意定监护制度尊重了被监护人的真实意愿,彰显了以人为本的理念,能够较好地应对老龄化社会所出现的监护相关法律问题。《中华人民共和国民法典》虽然对意定监护作出了规定,但相关制度并不完善。为此,应在借鉴国外关于意定监护制度相关法律规定的基础上,通过增设意定监护协议的规制条款、明确意定监护人的职责、引入意定监护的监督程序等方法完善我国意定监护制度。
Population aging is an undeniable fact. The voluntary guardianship system respects the true will of the guardian, highlights the people-oriented concept, and can better deal with the legal issues related to guardianship in an aging society. Although the Civil Code of the People's Republic of China has made provisions on voluntary guardianship, the relevant system is not perfect. Therefore, on the basis of drawing lessons from the relevant legal provisions of foreign countries on the voluntary guardianship system, we should improve our voluntary guardianship system by adding the regulation clauses of voluntary guardianship agreement, clarifying the duties of voluntary guardians, and introducing the supervision procedures of voluntary guardianship.
