摘要
美国“国家紧急图书馆”是为应对疫情期间公众基本文化诉求的一次有益尝试,其提前关停引发了对于数字图书馆建设和合理使用制度的思考。在无偿提供作品的合理使用制度失灵之时,不妨引入适当付费的公共借阅权制度以保障作者利益、促进数字图书馆长远发展。数字图书馆公共借阅权以权利的保护与限制为双重内核,有着扎实的学理基础和显著的社会利好,存在现实的立法实践,对我国图书馆事业意义非凡。在引入数字图书馆公共借阅权时,还应基于我国现实,对于适用范围、补偿金分配等进行本土化改造。
The National Emergency Library in the United States is a useful attempt to respond to the basic cultural demands of the public during the epidemic,but its early closure has led to thoughts on the construction of digital libraries and the fair use system.When the fair use system of providing works without compensation fails,it is better to establish a public lending right system with appropriate payment to protect the interests of authors and promote the long-term development of digital libraries.With the dual core of protection and restriction of rights,the public lending right of digital libraries has a solid theoretical foundation and significant social benefits.With realistic legislative practices,it could be of great significance to the library in China.When introducing the right of public access to digital libraries,the scope of application and the allocation of compensation should also be localized based on the reality in China.
