摘要
地理标志具有与普通商标一样指示商品来源的共性,但有明显不同的特性,即地名、商品通用名称通常因缺乏显著性而不可作为普通商标注册和使用,而地理标志发挥识别功能的真正内容恰恰是“地名+品名”文字表述。作为商品原产地经营者集体享有使用权的商业标识,地理标志对推动我国区域经济发展具有重要意义。因相关法律和规范不协调统一,多角度治理没有形成合力,目前尚未形成有效且适应地理标志保护需求的集体权利协同管理机制。地理标志保护中除了面对传统典型的外部假冒外,还存在多种原因造成的真假难辨和内部使用自我淡化。因此,在我国地理标志制度完善过程中,需要重视和解决假冒难以鉴别和侵权难以有效禁止问题,严控产区扩张,科学分类管理,抑制地理标志通用化趋势。
Geographical Indication(GI)is broadly a commercial mark indicating the origin of products,with the literal expression of"place name+product name"as its essence,which is perceived as non-distinctiveness from the perspective of normal trademark.GI as a sort of collective assets can play a significant role in promoting local economy,however,an efficient and well-coordinated legal system of GI management mechanism adapting for the needs of collective rights protection has not formed at present since the lack of systematic laws and regulations,and the scattered GI governance from different aspects.There are some problems in China’s GI protection practice besides the traditional counterfeit from outside the place of origin,such as the difficulty of differentiating internal counterfeit and dilution brought by different causes.Therefore,for the purpose of improving China’s GI system,it’s important to focus on and try to solve the problems of identifying difficulty,prohibiting counterfeiting effectively,as well as to control the expansion of region strictly,adopting appropriate management for different region scientifically,and restraining the trend of GI generalization.
