摘要
2021年1月,最高人民法院印发《关于深入推进社会主义核心价值观融入裁判文书释法说理的指导意见》,就社会主义核心价值观融入裁判文书释法说理的基本要求、案件范围、重点方法以及配套机制作出规定。该意见实施已满一年,针对司法实践中存在的困惑和问题,笔者就社会主义核心价值观融入裁判文书释法说理的理论基础、实践探索、原因剖析进行阐述,并有针对性地提出完善改进的合理化路径。
In January 2021, the Supreme People’s Court issued the "Opinions on Further Promoting the Integration of Core Socialist Values into Judgments,Interpretation and Reasoning"(hereinafter referred to as the "Opinions"), to stipulate the basic positioning of integrating core socialist values into judicial interpretations and reasoning, the scope of the case, the method of reasoning and the supporting mechanism. It has been one year since the implementation of the "Opinions". In view of the confusion and problems in judicial practice, the author intends to expound on the theoretical basis, practical exploration, and reason analysis of the integration of socialist core values into the interpretation and reasoning of judicial documents, and propose an improved path.
