摘要
《反有组织犯罪法》实质上部分修改了我国刑法关于惩治黑恶势力犯罪的既有规定。由司法规范确定的半正式制度,发展为专门法律规定的正式制度,是《反有组织犯罪法》中刑法规范的重要特征。在防治有组织犯罪的整体法秩序构建并运行之后,惩治规范与防治规范的功能协调,集中体现于惩治规范应以严格限制入罪、精准裁处刑罚为适用准则,防治规范努力追求最佳的有组织犯罪治理效果;具体表现为惩治规范以狭义有组织犯罪为适用对象,防治规范以广义有组织犯罪为适用范围。《反有组织犯罪法》新增涉有组织犯罪的治安规范,也是对刑法既有规范进行实质修改的方式,这种治安规范,因体系地位的特殊性,具有惩治规范和防治规范的双重功能。
The Anti-Organized Crime Law has partially modified the existing provisions of the criminal law on the punishment of crimes committed by gangs essentially.It is the important feature of criminal law in Anti-Organized Crime Law that the semi-formal system determined by judicial norms develops into the formal system stipulated provisions through special laws.After the construction and operation of the overall legal order of the prevention and control of organized crimes,the functional coordination of the punishment norms and the prevention and control norms has been mainly reflected in that the punishment norms should be the applicable criteria of strictly limiting the incrimination and accurate punishment,and the prevention and control norms strive to achieve the best effect of the governance of organized crimes.Specifically,the punishment criterion applies to the narrowly defined organized crime,while the prevention and control criterion applies to the broadly defined organized crime.The newly added public security stipulates concerning organized crimes in the Anti-Organized Crime Law is also a way to modify the existing norms of criminal law substantively.Due to the particularity of the system status,such stipulates have the dual functions of punishment and prevention,as well as governance.
