摘要
禽蛋兽药残留超标是农产品质量安全执法中常见的违法行为。本文梳理了禽蛋兽药超标相关案件查办的方法步骤,通过数据建模和量化分析指导的方式,推演违法行为发生时间,预判禽蛋药残消除时,指出了调查取证的重点,梳理分析了可以适用的法律条文和可能涉及的罚则事项,较为完整地呈现了办理禽蛋药残超标案的思考过程和执法要点,并对监督抽检与行政处罚衔接工作中存在的问题提出了有关思考,以期为执法人员迅速打开案件缺口,理顺案情经过,做好依法行政提供参考。
Excessive drug residues in poultry eggs are the illegal acts usually found during the law enforcement for quality and safety of agricultural products.For the purposes of supporting law enforcement personnel to quickly identify all gaps to a case,straightening out the course of the case and providing a reference for administration according to law,the methods and steps of investigation into the case related to excessive drug residues in eggs were summarized,the occurrence time of the illegal act was deduced through data modeling and quantitative analysis,and the elimination time of the residues was predicted,the key points for investigation and evidence collection were pointed out,all applicable legal provisions and possible penalties were summarized and analyzed,and the process of relevant thoughts during the case and key points for law enforcement were fully presented,especially the thoughts about the problems found during the connection between supervision or inspection and administrative punishment.
