中国共产党人知识产权法治观的生成逻辑论析 被引量:2

摘要 新中国成立以后,中国共产党人知识产权法治观的生成逻辑,可以划分为初步形成、快速发展、深化发展、丰富发展、系统完善等五个阶段,涵盖了“坚持独立自主,依法保护创造”、“加强法制建设,营造保护氛围”、“尊重知识产权,完善保护制度”、“实施国家战略,健全保护体系”、“倡导创新文化,全面依法保护”的科学意蕴。坚持系统观念,遵循中国共产党人知识产权保护观,能够为新时代提高知识产权保护工作法治化水平,推动全面依法治国战略布局与知识产权强国建设双向互动奠定思想基础。 Since the foundation of new China,the development of the CPC's intellectual property protection thought has gone through five stages:initial formation,rapid development,deepening development,comprehensive development,and the stage of enrichment and perfection,covering"adhering to independence and protecting creativity in accordance with the law","strengthening the legal system construction and forming a protective atmosphere","respecting intellectual property rights and perfecting the protection system","implementing the national strategy and improving the protection system","advocating innovation culture and protecting intellectual property".Adhering to the system concept and following the CPC’s concept of intellectual property protection can lay the ideological foundation for improving the level of legalization of intellectual property and promote the interactive implementation of the strategy of comprehensive rule of law and the strategy of Intellectual Property Power.
