摘要
特殊打赏者指通过高额、多频次的打赏行为,在特定直播间打赏者社群中获得超然的身份认同,在网络直播的过程中与特定主播互相精神鼓励,对该主播直播行为具有一定操纵、决策、管理作用的特殊主体,其认定标准为互动性高、鼓励意图明显以及行为前置性。特殊打赏者置身于网络直播犯罪的因果流程中,能够对主播的犯罪行为产生影响,相较于网络直播犯罪中另一主体——网络直播平台,其主观非难性更大,行为危险性更强,更应受到我国《刑法》的规制。在我国《刑法》的具体适用中,根据共同犯罪理论,对于网络直播犯罪中的特殊打赏者,仅以打赏的行为方式参与到犯罪过程中,或通过打赏行为和主播进行交互,或与主播基于共谋的意思表示实施共同犯罪行为,可分别认定为帮助犯、教唆犯以及共谋共同的正犯。
