摘要
为了保障人民法庭工作人员的生命安全,选取H省C市43个人民法庭的工作实例,就人民法庭审理涉农离婚案件在起诉前后、庭审中、庭审后、判决后、执行等阶段表现出来的各种风险进行展示,并从硬软件严重不足、当事人新需求新期待、调解难度不断加大、心理干预机制严重匮缺、社会关怀机制尚未建立等方面探讨风险产生的原因,以及从加强软硬件建设、积极应对突发事件、发挥多元化纠纷解决机制功能、建立健全心理干预机制、建立社会关怀机制等方面提出防范对策,以期对保护人民法庭工作人员的生命安全有所裨益。
In order to ensure the life safety of the people’s court staff,this paper selects 43 people’s courts in C City of H Province to show the various risks in the process of people’s court divorce cases related to agriculture before and after the prosecution,in the court trial,after the court trial,after the judgment,in execution and other stages,and discusses the causes of the risks from the following aspects:the serious shortage of hardware and software,the updating needs of the parties,the increasing difficulty of mediation,the serious shortage of psychological intervention mechanism,and the lack of social care mechanism.The paper also puts forward countermeasures from the aspects of strengthening the construction of software and hardware,actively responding to emergencies,giving full play to the function of diversified dispute resolution mechanism,establishing and improving the psychological intervention mechanism,and setting up social care mechanism,so as to be beneficial to the protection of the life safety of the people’s court staff.
