摘要在全球疫情蔓延之势下,法定数字货币在跨境支付领域的需求日益剧增。全球多国央行和国际金融组织已将法定数字货币跨境支付列为优先事项,未来将形成新一轮的货币竞争,或将颠覆全球个人支付方式,改革全球货币发行机制和重塑贸易结算体系。当前,法定数字货币的各项基础规则和配套制度仍处于全新的探索阶段。基于货币国家理论,法定数字货币在跨境支付中将面临货币主权矛盾和域外效力的确认,跨境支付标准的不统一,以及国际监管规则和协调机制创新等诸多法律问题。故,大国治理,机柕万端,循法治币。中国应尽快推进法定数字货币在跨境支付方面的国内立法,推动区域基础设施与货币互换网络机制的建设;同时,应积极参与法定数字货币跨境支付标准与国际规则的制定,探索多元化监管的国际合作路径,以强化自身金融主权与国际规则制定的话语权。 With the global epidemic spreading,the demand for CBDC in the field of cross-border payment is increasing rapidly,which can make up for the shortcomings of the existing payment system.Many central banks and international financial organizations around the world have made CBDC cross-border payment a priority.In the future,there will be a new round of currency competition,which may subvert the global personal payment mode,reform the global currency issuance mechanism and reshape the trade settlement system.At present,the basic rules and supporting systems of CBDC are still in a new stage of exploration.Based on the state theory of money,CBDC in cross-border payment will face many legal problems,such as the contradiction of monetary sovereignty and the confirmation of extraterritorial effect,the inconsistency of cross-border payment standards,and the innovation of international regulatory rules and coordination mechanism.China should formulate and improve the domestic legislation on cross-border payment of legal digital currency as soon as possible,and promote the construction of regional infrastructure and currency swap Network Mechanism.Furthermore,China should actively participate in the formulation of cross-border payment standards and international rules of legal digital currency,and explore the international cooperation path of diversified supervision,so as to strengthen its own financial sovereignty and the discourse power of international rule-making.
