摘要
社区矫正作为一种非监禁刑罚,自西方国家引入我国,与监禁刑罚互为补充,完善了我国的刑罚执行方式。从试点阶段到社区矫正法律初步形成再到社区矫正法颁布,社区矫正历经18年的发展逐渐完善。与之对应的检察机关的检察监督机制也在不断探索中前进,特别是《社区矫正法》颁布之后,检察机关的检察监督工作也随之发生了相应的变化。文章梳理了社区矫正相关法律的历史沿革,分析部分检察监督职能的变化,从人才、手段、模式、主体几个方面分析检察机关在社区矫正检察监督工作中遇到的问题并提出对策,以期促进我国社区矫正检察监督工作进一步发展。
As a non-custodial penalty,community correction has been introduced into China from western countries,which complements the custodial penalty and improves the execution of penalty in China.From the pilot stage to the initial formation of Community Correction Law and then to the promulgation of Community Correction Law,community correction has been gradually improved after 18 years of development.Correspondingly,the procuratorial supervision mechanism of the procuratorial organs is also advancing in constant exploration,especially after the promulgation of the Community Correction Law,the procuratorial supervision of the procuratorial organ has also undergone corresponding changes.This paper combs the historical evolution of community correction and analyzes the changes of some procuratorial supervision functions.Analyzing the problems of procuratorial supervision in community correction from the aspects of talents,means,modes and subjects,this paper puts forward some countermeasures so as to promote the further development of procuratorial supervision in community correction.
