摘要
环境保护与经济发展之间的矛盾始终存在于人类的生产、生活之中,作为两者博弈的产物,环境保护制度起着居间调和的作用。在众多环境保护制度之中,自然保护地为协调保护与发展的矛盾、促进人类社会的可持续发展做出了巨大的贡献。而国家公园作为我国自然保护地体系建设的主体目标,其制度本身便承载着严格保护自然生态系统和合理利用环境资源的双重目的。与国家公园制度的目的要求相比,当前国家公园体制试点普遍存在分区管控制度设计不足、多方参与机制不完善、管理部门间关系尚未理顺等问题,需要在现有的自然保护地法律体系和国家公园试点地区立法的基础上进行系统梳理,进一步完善权责体系,建立相应的制度机制,为国家公园的立法奠定基础。
The contradiction between environmental protection and economic development always exists in human production and life.As a product of the game between the two,the environmental protection system plays an intermediary role.Among many environmental protection systems,nature reserves have made great contributions to coordinating the contradiction between protection and development and promoting the sustainable development of human society.National parks,as the main objective of the construction of my country's protected area system,carry the dual purpose of strictly protecting the natural ecosystem and rationally using environmental resources.Compared with the objectives and requirements of the national park system,the current pilot projects of the national park system generally have problems such as insufficient zoning management control system design,imperfect multi-party participation mechanism,and unaligned relations between management departments.The existing legal system for nature reserves is required.On the basis of the legislation of pilot areas of national parks,carry out a systematic review,further improve the power and responsibility system,establish corresponding institutional mechanisms,and lay the foundation for national park legislation.
