摘要
国家公园管理局是管理国家公园的组织形式。从行政组织法角度看,我国国家公园组织设置呈现多样化,具有行政机关、公法人和行政署三种属性。它存在行政管理和专业管理不分、决策、执行和监督之间分工不明确、组织隶属关系不明晰、责任归属难以理清等组织构造难题。这就需要在国家主导管理目标下完善国家公园管理局组织设计,建构符合行政组织法要求的组织框架,即一是根据职能定位明确国家公园管理局的机构定位;二是加强国家公园管理局决策、执行和监督的内部分工;三是梳理国家公园领导体制中行政管理机构和专业管理机构的组织隶属关系;四是理清国家公园管理的责任归属和责任配置。
The National Park Administration is an official organization of managing national parks.From the perspective of administrative organization law,the organizational setup of national park system in China is mixed with three features as the executive department,the public corporation and the administrative office.Some organizational structure problems come up such as indistinction between administrative management and professional management,lack of power division between decision-making,implementation and supervision,disorder of administrative subordinations,and ambiguity of responsibility attribution.Therefore,it is necessary to improve the organizational design of the National Park Administration system in order to construct an organizational framework in accordance with the requirements of the Administrative Organization Law:firstly,to define institutional location of the National Park Administration based on its functional orientation;secondly,to intensify power division between decision-making,implementation and supervision departments in the National Park Administration;thirdly,to classify subordination relationship of the administrative and the professional departments in the National Parks leadership system;and fourthly,to clarify responsibility ownership and responsibility allocation in management of the National Parks.
