摘要
监察委员根据需要提出书面商请,检察机关指派员额检察官提前介入职务犯罪调查,依法进行监督式配合和引导式制约。监察委员会主导调查和移送起诉,需要明确提前介入阶段两个主观“认”的客观判断,把握提前介入调查阶段“罪、罚”的认定,精确提前介入阶段“从宽”的考量。同时对证据进行收集、固定和完善,以及对调查补证的思路、方向、重点等内容进行调整。整个诉讼中检察处于主导地位,监、检配合融通并监督制约关系让据以认定认罪认罚的证据能够按照个案特点进行收集和审查,符合庭审和裁判要求,提高职务犯罪的调查和起诉质量,保障被调查人的权利。以提前介入亲历性的监、检配合并制约的办案模式构建以证据为核心的刑事犯罪一体化指控体系。
In the investigation of job-related crimes,the Supervisory Committee shall submit written requests for consultation as necessary.After written consultation by the supervisory organ,the procuratorial organ carries out supervisory cooperation and guided restriction on dispatching rated procurator to intervene in the investigation ahead of time.In the stage of investigation and transfer to prosecution,the supervisory committee is in the leading position.The procuratorial organ performs the function of legal supervision and only plays a supporting role in the investigation and punishment of duty crimes that belong to the investigation of the supervisory committee.The two organs need to clarify the objective judgment of two subjective"recognition"in the early intervention stage,grasp the determination of"crime and punishment"in the early intervention stage,and consider"leniency"in the accurate early intervention stage,so as to guide investigators to collect,fi x and improve evidence,as well as putting forward opinions or suggestions on the thinking,direction and focus of the investigation supplement certifi cate and.In the whole lawsuit,the procuratorial organ is in the leading position,procuratorial intervention in advance and coordination of supervisory organs with accommodation and supervision and restriction,which enables each evidence to identify guilty plea and punishment to be collected and reviewed in accordance with the characteristics of each case,meets the requirements of trial and judgment,improves the quality of investigation and prosecution of duty-related crimes,guarantees the rights of the respondents.
