摘要
评估模式的选择是立法后评估的重要内容,在很大程度上决定了评估工作成效的取得。针对目前实践中评估方法片面化、单一化的问题,借鉴《Y市农村生活垃圾管理条例》立法后评估提出的“三全评估”模式,即评估地域全覆盖、评估方法全运用、评估事项全方位。注重评估制度的法制化、评估方法的多样性、评估的公众参与及评估结果的整理,有助于确保立法后评估真正发挥实效,服务于地方法治建设,有序推进地方立法质量和立法水平的提升。
The choice of evaluation mode is an important content of post-legislative evaluation,which determines the effectiveness of evaluation to a great extent.In view of the problem of one-sided and single evaluation method in current practice,the“Three-entire evaluation”model proposed by the post-legislative evaluation of“Regulations on the Management of Rural Domestic Waste in Y City”is used for reference,that is,the evaluation area is fully covered,the evaluation methods are fully used,and the evaluation items are all-round.Paying attention to legalization of evaluation system,diversity of evaluation methods,public participation in evaluation and collation of evaluation results will help to ensure that post-legislative evaluation will really bring into effect,serve the construction of local rule of law,and promote the improvement of local legislative quality and level in an orderly manner.
