摘要信用日益受到公众关注并使我国信用监管逐步转向法治化轨道。社会信用体系建设是一项巨大而复杂的系统工程,是我国自2014年起重点关注、全面开展的一项重要工作。宪法规定检察机关是国家的法律监督机关,其在社会信用体系建设中占据独特的地位。发挥法律监督权在社会信用体系中的作用,可以从以下几方面考量:第一,发挥法律监督作用是检察机关的分内职责;第二,当前四大领域行政公益诉讼范围亦有维护信用之意;第三,基于拓展行政公益诉讼范围的要求。在实现建成法治国家、法治政府、法治社会的进程中,应当通过拓展行政公益诉讼范围、强化法律监督意识、完善信用立法相关规定、提升检察机关工作人员的素质,为检察机关法律监督权在社会信用体系建设中的运行开拓空间。 Credit is increasingly receiving public attention,and my country's credit supervision is gradually turning to the track of rule of law.Social credit system construction is a huge and complex system project,which has been an important work that my country has focused on and carried out comprehensively since 2014.The constitution stipulates that the procuratorate is the legal supervision organ,which makes it occupy a unique position in the social credit system construction.The function of the legal supervision in the social credit system can be considered from the following aspects:First,playing the function of legal supervision is the internal duty of the procuratorate.Second,the current four major areas of administrative public interest litigation also have the meaning of safeguarding credit.Third,based on the requirements of expanding the scope of administrative public interest litigation.In the process of building a country,a government and a society ruled by Law,it is necessary to expand the scope of administrative public interest litigation,strengthen the awareness of legal supervision,improve the relevant provisions of credit legislation,and enhance the quality of procuratorate staff,open up space for the operation of the legal supervision power of procuratorate in the social credit system construction.
